Frequently Asked Questions for Ontario Landlords
Landlord and tenant issues often come with questions about rights, responsibilities, and next steps. Understanding the process early can help you avoid costly delays and make informed decisions.
Here are answers to some of the most common questions landlords ask about evictions, rent arrears, lease issues, and Landlord and Tenant Board (LTB) procedures in Ontario. These FAQs are intended to provide general information and help you better understand your options.
If your situation is unique or requires specific legal guidance, we encourage you to contact us to discuss your matter in more detail.
1. Can I evict a tenant for not paying rent?
Yes, but it is not as straightforward as you might believe. In short, the decision to issue an eviction order is at the discretion of the Landlord and Tenant Board (LTB).
The LTB is the only authority in Ontario that can issue an eviction order.
To begin the application process, contact us. We will handle the entire process for you.
2. Can I remove a tenant for damage or disturbance?
Yes, however, the decision ultimately rests with the Landlord and Tenant Board (LTB).
The LTB is the only governing body in Ontario with the legal authority to issue an eviction order.
We can prepare and serve the required forms based on the specific issue and assist you in selecting the correct one.
3. What if the tenant already moved out but owes rent?
You have one year from the date they moved out to file with the LTB.
Otherwise, you may still file a claim, but it must be done through a Small Claims Court action.
If successful, this could result in wage garnishment or other forms of collection, including garnishment through a court-ordered judgment.
We offer this service at a flat rate.
4. Can I meet virtually?
Yes — we meet clients by phone, or Zoom throughout Ontario.
5. Can you attend my LTB hearing for me?
Yes — we represent landlords at LTB hearings across Ontario. All LTB hearings are now conducted remotely.
