Here are answers to some common questions. 


Notary Public Services


We can notarize and certify all types of documents. Notarizing documents in Ontario has different reasons. Languages other than English can be used in documents. Notaries identify you and witness your signature.


The Notary will require evidence of your identity, such as a driver's license, passport, PR card, citizenship certificate, etc. A photograph and your full name must appear on the document. It is required that the person whose signature is being notarized physically appears before the Notary and signs. Bring a witness if you need one for your document. Alternatively, we can provide an independent witness from our office if you cannot bring one. This will cost you an additional fee.


Affidavits


With our professional affidavit drafting service, we draft the affidavit and review it. Upon request, our paralegals can even commission the affidavit for you. You can provide us with specific information in an email to help us prepare the draft. After the first draft is ready, we send it to you for review and revision. Once the final document is ready, if needed, you can sign it and have it commissioned in our office. Our same-day document drafting service is available if you need it immediately.


Statutory Declaration


A statutory declaration is a written statement of facts attested to by a notary public or commissioner of oaths. In the same way that statutory declarations have legal effect, sworn statements and affidavits do as well. False statements can be prosecuted as perjury under the Criminal Code. Professional document drafting services include preparing a draft declaration, reviewing it with you, and witnessing it.


We can prepare a draft for you if you provide us with relevant details via email. Our first draft will be sent to you for review and correction once it has been completed. We can commission/notarize the final draft if needed, once it has been completed. It is usually possible to complete the entire process on the same day. We will charge you for document drafting and notarization in this case.

We can also notarize and commission the draft declaration prepared by you. As a standard fee for each notarization, we will charge this notarization.


Planning a Wedding Outside of Canada?


In case you are planning a wedding abroad, make sure you obtain all the necessary documents before moving forward. The Canadian government generally requires a Statement of Non-Impediment to Marriage Abroad instead of a Certificate of Non-Impediment. As well as a Statutory Declaration of your Marital Status, you will need your Birth Certificate, Driver's License, and/or Passport.

If you are divorced, you will need notarized copies of your Marriage Certificate, Divorce Order, and Divorce Certificate.


A document's authenticity is furthermore determined by the requirements of each country. Some countries require that these documents be authenticated and legalized in Canada in order to accept them.


Licensing Exam Applications


Occasionally, our clients are unable to commission their documents in person. Besides weather, convenience, privacy, mobility issues, and unavailability nearby, our mobile notary service also considers other factors. You don't need to worry! We are happy to assist you if you need help. Your documents can likely be commissioned at your location by our Commissioner of Oaths.


Used Vehicle Transfer Forms


You may be able to transfer ownership of your vehicle to a family member without paying retail sales tax in Ontario. Among the eligible relationships are spouses, parents, stepparents, grandparents, step-grandparents, sons or stepsons, daughters or stepdaughters, grandchildren or step-granddaughters, sons-in-law, daughters-in-law, fathers-in-law, mothers-in-law, siblings, half-siblings (siblings whose parents are the same), and adopted siblings.


Those who wish to donate a used motor vehicle as a gift to their family in Ontario are also required to submit a sworn statement. You can find this form on the website of the Ontario government. To notarize and sign this completed form, please bring it to our office so that we can notarize it.


To facilitate the identification process, the Notary will require you to present a government-issued photo identification document, such as your driver's license, passport, PR card, citizenship certificate, etc., to verify your identity. Please note that the document must include a photo as well as your full name.


Attestation of Documents


In Canada, documents can be attested by three different services:


  • Notarization of documents by a notary public
  • A commissioner of oaths administers oaths
  • It is the Notary Public who notarizes a true copy of the original document.


In documents, only what is needed should be written. Depending on the institution or office that requires attestation, you may have to contact them. A document usually contains the requirements.

Passport Applications


For a Canadian passport, applicants must find a guarantor who has known them for at least two years. The "Instead of Guarantor form" can be completed and signed if you cannot find a guarantor. A passport office is the only place where you can find this form. It is necessary to commission this form through a Notary Public to be legally binding. If you mail your application, you will need certified copies of your supporting documents. Notarization of this form is available upon request.


A Notary Public must witness the applicant's signature on the statement before approving it. Identifying documents such as driver's licenses, passports, PR cards, citizenship certificates or other similar documents are required by notaries. There must be a photograph and your full name on the document. To have their signature notarized, the applicant must appear in person and sign in front of the notary public.


Our mobile notary service is also available in case you cannot visit our office. At the moment, only a few regions offer this service by appointment.

Name Change Applications


For name change applications, we provide notarization services. To complete the name change application, the applicant must visit our office and sign the document in front of a Notary Public. The Notary will require you to present a Government-issued photo identification document such as a driver's license, passport, PR card, citizenship certificate, etc.


There must be a photograph and your full name on the document. A notary must physically witness the signing of the person whose signature is being notarized. We also provide Mobile Notary Service if you cannot visit our office. Presently this service is only available in select regions with a prior appointment. 



Degree Certificates

Our 'Certified True Copy' service is available when you have an original document and wish to notarize and certify a copy. Typically, these documents are educational documents such as degree certificates, diplomas, transcripts, and reference letters. The documents we certify in our office every day are used domestically or internationally by clients. For us to examine the original and compare it to the photocopy, you must bring the original document to our office. 


A black-and-white photocopier is available in our office, and we can make photocopies at no extra charge. Photocopiers in colour are also available, but there is an additional fee for colour copies.


Each document must be notarized and copied separately. The passport and driver's license, for instance, cannot be notarized together. Copying and notarizing them separately must be done on two separate pages. A notarized document does not have to be your own, and you can notarize the original document of another person.


Electronic Document Certification

Upon reviewing the original document on our office computer and printing it out on our office printer, we can notarize the document if it can only be found on the website or online account of an individual. Printouts will be certified as true copies by our Notary Public.

If you wish to log in online, you will need to bring the website address or other credentials. Our office can view and print the web link if you open it in our office. Documents must be watched by the Notary Public while they are being downloaded.

Any language can be used for the original documents on the website.


Notarization fees are charged as normal and there is no extra charge for Electronic Document Certification.

Alternatively, if you cannot visit our office, we provide mobile notary services. Currently, only an appointment is required for this service in the GTA.

Common Law Declarations


A Common Law Declaration is a sworn statement under Canada's laws (i.e. a statutory declaration). Immigration, Refugees & Citizenship Canada (IRCC) often requires spousal sponsorship applications, from couples who are not formally married to each other. In the absence of a marriage, this statutory declaration proves the relationship. You should prepare the draft declaration yourself and bring the final printed copy to our office for signature and commissioning/notarization. In this case, our standard notarization fee will apply.

Insurance Proof of Loss Forms


Proof of Loss is a statement that documents the details of damaged or destroyed items and the amount of money being requested. In the presence of a notary public, the policyholder signs and swears to the form. Insurers use the form to facilitate the investigation of their claims and protect their interests.


Proof of loss forms typically asks for the following information:


  • Describe the type of damage sustained
  • What was covered by the policy
  • Damaged or destroyed property's current replacement value
  • Evidence that the loss has occurred


Each insurance company has its proof of loss form. In addition to any government regulations that may apply, the form also reflects the specific requirements of the insurer.


OSAP Affidavits & Forms


Among the services we offer is the drafting of OSAP affidavits. Affidavits for OSAP may include sworn statements of income (or lack of income) or single or common law status during a particular year. Also included is a statement about the income support you receive from your parents. In conjunction with OSAP or any other office that requests an Affidavit, we can draft this Affidavit for you. Let us prepare the draft based on the details you send us via email. We send you the initial draft for your review and feedback once it is prepared.


You can come to our office for signatures and notarization once the final draft is ready. It usually takes a couple of hours to complete the entire process on the same day. Our fee will include the cost of document drafting and notarization. You may also prepare the draft affidavit yourself and bring the final printed copy to our office for signing and notarization. Our standard notarization fee will apply in this case.

RRSP Withdrawal Applications


If you are withdrawing from an RRSP, you may be asked to sign a sworn affidavit. As a result, you must swear or affirm before a Notary Public, Commissioner, or another person authorized to take affidavits that the contents of the form are accurate and true. We will be happy to assist you in this matter. All types of documents, including withdrawal applications for RRSPs, can be notarized and certified by us. Notaries are usually responsible for verifying your identity and witnessing your signing of documents.


To prove your identity, the Notary will require you to present a government-issued photo identification document, such as a driver's license, passport, PR card, citizenship certificate, or other similar document. A photograph and your full name must appear on the document. Those who wish to have their signature notarized must appear in person and sign in front of the Notary Public. Alternatively, we can arrange for someone from our office if you are unable to bring an independent witness.



Employment ID Verification Forms


Documents of all kinds, including Employer Identity Verification forms and letters, can be notarized and certified by us. It is possible to notarize these documents for use within Ontario, outside Ontario, or even outside of Canada for a variety of reasons. Over the years, we have notarized thousands of documents used by our clients outside of Ontario and Canada. Documents can be written in any language, including foreign languages. Notaries are usually responsible for identifying you and witnessing you sign documents.


A government-issued photo identification document, such as a driver's license, passport, PR card, citizenship certificate, or other similar document, will be required for identification. Your full name and photograph must appear on the document. It is a legal requirement that the person having their signature notarized appear and sign in front of the Notary. Bring someone with you if your document requires an extra witness. If you are unable to bring an independent witness, we can arrange a witness from our office at an additional cost.

DISBURSEMENTS


Here's how it affects your final bill.

"Plus disbursements" often accompany any information related to legal fees. Without a proper explanation, it is nearly impossible not to worry about how it affects your overall bill. Disbursement in the legal profession refers to any expense the firm incurs on your behalf.


Depending on the firm and your billing agreement, this may include court filing fees, process server or courier costs for photocopying and long-distance tolls. Per the widely accepted practice in the legal profession, disbursements are billed separately and in addition to other fees.
