Defending a Traffic Violation


Offence Notice

The most common type of traffic ticket is an Offence Notice. A person who has received an Offence Notice has three options. In addition to signing the ticket, pleading guilty to the charge and paying the fine, you can also pay the fine online. As a second option, you can plead guilty and explain your actions. Usually, this means going to the courthouse and speaking to a justice of the peace.


Depending on your explanation, a justice of the peace may reduce or extend your fine payment deadline. As a third option, you can choose to have the charge disputed at trial. Choosing this option will require contacting the court office and attending court.


The ticket will be reviewed by a justice of the peace if you do not respond within 15 days of receiving it, or if you do not appear for your trial; if the ticket does not contain any fatal flaws, you will be found guilty. If the ticket contains a fatal flaw, the court can dismiss it. When a ticket doesn't have the defendant's name on it, the date of the offense is missing, the location is unidentified, or the officer didn't sign it, it has a fatal flaw. Minor errors, such as misspelled names, do not constitute fatal flaws.


Parking Infraction Notice

There are two options for parking tickets:

  1. Plead guilty by paying the full amount, or
  2. Request a trial date by following the instructions on the back.


You may be found guilty if you fail to comply with the above regulations within 15 days, or if someone on your behalf fails to appear in court for your trial.


Summons

A summons is the third type of ticket. Court summonses require you to appear at a given time and date. Failure to appear in court is an offense. A summons indicates that you have been charged with a serious offense. Our team of paralegals can provide you with assistance if you have received a summons.


In most cases, summonses are issued for more serious offenses, such as failure to remain at the scene of an accident, driving while suspended, or driving without insurance. Usually, these offences are punished with fines between $500 and $5,000, license suspensions, or jail terms.


There are several things you can do to prepare your case if you decide to fight your summons on your own. You should begin preparing right away, while your memory of the incident is still fresh. Get all the information the prosecution has against you regarding the section of the Highway Traffic Act you have been charged under. This is known as disclosure. Additionally, you should decide if witnesses will be called.


It can be a good idea to plea bargain with the prosecution in some cases. You make a plea bargain with the prosecutor in exchange for a reduction in the charges against you. In this case, the charge might be "following too closely" instead of "careless driving". It may result in a reduced fine and/or fewer demerit points. Talk to the prosecutor about plea bargaining if you are interested.
