What Is an N4 Notice?
An N4 Notice to End a Tenancy Early for Non-Payment of Rent is typically the first step when a tenant has not paid rent in full. The notice advises the tenant of the amount owing and provides an opportunity to pay the arrears within the required notice period.
The notice must be completed accurately and served properly. Errors in the notice can lead to delays, dismissed applications, and additional costs for landlords. Ensuring the notice complies with the Residential Tenancies Act is critical before moving forward.
When Can a Landlord File an L1 Application?
If the tenant does not pay the arrears by the deadline contained in the N4 Notice, a landlord may be eligible to file an L1 Application with the Landlord and Tenant Board.
An L1 Application allows the landlord to seek:
An eviction order;
Payment of rent arrears;
Ongoing compensation in certain circumstances; and
Recovery of certain filing-related costs permitted by law.
Filing promptly can help prevent arrears from continuing to grow while waiting for a hearing date.
